This document establishes the conditions by which the use of the mobile application: PUFF CLEANING SERVICES (hereinafter the application) will be governed, which is operated by PUFF CLEANING AND REPAIR HODINGS LLC, a company incorporated in the United States and domiciled in the city of Miami, Florida (hereinafter PUFF CLEANING). The application will function as a channel for the management of the provision of services by PUFF CLEANING employees, in accordance with the established schedule. The user undertakes to read the terms and conditions established herein, before downloading the application, therefore, in case of installation, it is understood that he/she has the full knowledge of this document and the consequent acceptance of all its stipulations. The user acknowledges that the entry of their personal information, and the data contained in the application at their disposal for the purpose of the application by PUFF CLEANING is carried out voluntarily. Those who choose to access this application, regardless of their geographical location, do so on their own initiative and are responsible for compliance with the applicable laws in each of the cities, states, and countries where the download is made. In the event that it is accessed by minors, they must have the supervision of an adult at all times from the download and during the use of the application, in the event that this condition is not met, we thank you for not using the application. RANGE AND USE The user of the application understands and accepts that it is nevertheless operated by PUFF CLEANING and the information contained therein will be that referring to the relationship between the user and PUFF CLEANING under the relationship made. The application will make information available to the USER and/or will allow the performance of the processes determined or enabled by PUFF CLEANING for the different profiles. PUFF CLEANING may add, modify, or remove the functionalities at any time, which the user accepts by installing the application. In any case, at the time of making such modifications, the user will be notified through the same mobile application once logged in. Response times, procedures, and other requests made by the user through the application will be processed in accordance with the specifications of each product or service active by PUFF CLEANING. The user accepts and authorizes that the electronic records of the aforementioned activities carried out in the application constitute full proof of these. REQUIREMENTS FOR USE The user must have a smart mobile device (Smartphone) or Tablet with an Android or IOS operating system, any of these with internet access, both secure and reliable. PUFF CLEANING will not be responsible for the security of the Smartphone equipment owned by the users used to access the channel nor for the availability of the service on the devices on which the application is downloaded. To the extent permitted by law, the materials on the App are provided without warranty of any kind, express or implied, including without limitation warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement, therefore, PUFF CLEANING does not warrant proper operation on the various operating systems or devices on which the App is used. To access the portal, THE USER will have a Username and Password, that identifies him in his relationship with PUFF CLEANING, which will be the same as those used in the web portal. OBLIGATIONS OF USERS. The User undertakes to use the application and the contents found in it in a diligent, correct, lawful manner and undertakes NOT to engage in the conduct described below: (a) Use the contents in a way, for purposes or effects contrary to the law, morality, and generally accepted good customs or public order; (b) Reproduce, copy, represent, use, distribute, transform, or modify the contents of the application, by any procedure or on any medium, in whole or in part, or allow public access through any form of public communication; (c) Use the content in any way that poses a risk of damage to or disabling the application or the content or third parties; (d) Deleting, evading, or manipulating the copyright and other identifying data of the copyright incorporated into the contents, as well as the technical protection devices, or any information mechanisms that the contents may have; (e) Use the contents and, in particular, the information of any kind obtained through the application to distribute, transmit, send, modify, refuse, or report the advertising or the contents of the application for direct sales purposes or for any other type of commercial purpose, unsolicited messages addressed to a plurality of people regardless of their purpose, as well as to market or disclose in any way such information; (f) Do Not allow any third party other than you to use the mobile application with your password; g) Using the application and the contents for lawful and/or illicit purposes, contrary to the provisions of these Terms and Conditions, or to the use of the application itself, which are harmful to the rights and interests of third parties, or which in any way may damage, disable, overload or deteriorate the application and the contents or prevent the normal use or enjoyment of it and the contents by users. INTELLECTUAL PROPERTY All computer, graphic, advertising, photographic, multimedia, audiovisual, and design material, as well as all the contents, texts, and databases made available to you in this application, are protected by copyright and/or industrial property owned by PUFF CLEANING, in some cases, by third parties who have authorized their use or exploitation. Likewise, the use in the application of some materials owned by third parties is expressly authorized by law or by such third parties. All content in the application is protected by copyright regulations and by all national and international regulations applicable to it. Except as expressly provided in these Terms and Conditions, any act of copying, reproducing, modifying, creating derivative works from, selling or distributing, displaying the contents of this application, in any manner or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or any other means, without the prior written permission of PUFF CLEANING or the owner of the respective rights, is prohibited. In no event do these Terms and Conditions confer any rights, licenses, or authorizations to perform the foregoing prohibited acts. Any unauthorized use of the contents will constitute a violation of this document and of the current regulations on copyright, the current national and international regulations on Industrial Property, and any other that may be applicable. INTEGRATION WITH OTHER APPLICATIONS Facebook®, Instagram®, and X® links in this app may display content that is not under the control of PUFF CLEANING. Although this PUFF CLEANING application tries to provide links only to third-party sites and applications that comply with applicable laws and regulations and PUFF CLEANING's rules, the User should understand that PUFF CLEANING has no control over the nature and content of those sites and is not recommending these sites, the information contained therein or the products or services of third parties. PUFF CLEANING does not accept responsibility for the content of a third-party site to which there is a hypertext link and does not offer any warranty (express or implied) as to the content of the information on those sites, as it does not recommend these sites. You should check the terms and conditions, and legal and privacy policy sections of some other PUFF CLEANING sites or a third party to which you link. PUFF CLEANING assumes no liability for any direct, indirect, or consequential loss due to the use of a third-party site. USE OF INFORMATION AND PRIVACY By downloading the APP, you accept and authorize PUFF CLEANING to use your data as a data controller for purposes arising from the execution of the APP. PUFF CLEANING informs that you may exercise your rights to know, update, rectify, and delete your personal information; as well as the right to revoke the consent granted for the processing of personal data provided for by law, following the terms and conditions and the privacy policy available in www.puffcleaning.com. In accordance with the above, you authorize the processing of your information in the terms indicated, and transfer to PUFF CLEANING in full, and without limitation my image and copyright rights, voluntarily, prior, explicitly, informed, and unequivocally. PUFF CLEANING'S RESPONSIBILITY FOR THE OPERATION OF PUFF CLEANING SERVICES. PUFF CLEANING will endeavor to ensure the availability, continuity, or proper functioning of the application. PUFF CLEANING may block, interrupt, or restrict access to it when it deems it necessary for the improvement of the application or when it has been canceled. The User is recommended to take appropriate measures and act diligently when accessing the application, such as, for example, having protection programs, and antivirus, for handling malicious programs, spyware, and similar tools. PUFF CLEANING will not be responsible for: a) Force majeure or fortuitous event; b) For the loss, misplacement, or theft of your mobile device that implies access by third parties to the mobile application; c) Due to typing errors or access by the client; d) For damages, loss of profit, consequential damages, moral damages, and in general sums to be paid by PUFF CLEANING, for delays, non-processing of information or suspension of the mobile operator's service or damage to mobile devices. DENIAL AND REMOVAL OF ACCESS TO THE APPLICATION If a User breaches these Terms and Conditions, or any other applicable provisions, PUFF CLEANING may suspend their access to the application. TERMS AND CONDITIONS The User expressly accepts the Terms and Conditions, which is an essential condition for the use of the application. If you disagree with these Terms and Conditions, we ask you to leave the application immediately. PUFF CLEANING may modify these terms and conditions, notifying the users of the application by publishing it on the PUFF CLEANING website or by disseminating the modifications by any electronic means, social networks, SMS, and/or email, which will be understood to be accepted by the user if he continues to use the application. JURISDICTION These terms and conditions and everything that has to do with this application, are governed by the laws of the State of Florida. USE OF NON-PERSONAL INFORMATION PUFF CLEANING also collects non-personal information in aggregate form to track data such as the total number of app downloads. We use this information, which remains in aggregate form, to understand the behavior of the application.
